Terms of individual consultations of “Klīnika Dzintari” Ltd. via virtual channels of communication
1.1. These regulations provide for the procedure by which \ “Klīnika Dzintari” Ltd. (hereinafter – the Clinic) provides its patients with the opportunity to receive consultations through communication channels chosen by the client (e.g. WhatsApp, Zoom, Skype or others) (hereinafter – the communication channel).
1.2. In consultation communication channels, it is possible to receive the help of a psychiatrist, psychologist, psychotherapy specialist, art therapist, if a face-to-face meeting is not possible. Consultations via communication channels do not replace consultation in the doctor’s office, however, it is a good alternative if the patient is located in a place where specialist help is not available or is not available in a language that the patient knows (eg, temporarily or completely abroad).
1.3. Consultations in communication channels ensure mutual communication in the form of a conversation and allow partial observation of non-verbal communication, as well as ensure regular meetings, which are important in the treatment process.
1.4. Consultations in communication channels provide an opportunity to receive consultations with time and financial economy.
1.5. If possible, it is essential to meet with a specialist in person before consultations through communication channels.
2.1. In order for the Clinic to be able to provide consultations to the patient through one of the communication channels, the patient must have access to a computer, tablet or smartphone with an Internet connection, an installed app for the relevant communication channel, a microphone and a video camera.2.2. During the consultation, the communication channels always use a video call, during which both the specialist and the patient see each other with the help of a video camera. The clinic and the patient ensure that consultations are not recorded on communication channels.2.3. During the consultation, outsiders must not be in the rooms where the specialist and the patient are.2.4. The patient is responsible for complying with the conditions set forth in this paragraph. Their non-fulfillment or improper fulfillment may be grounds for refusal of consultation.
3. Payment procedure3.1. The patient makes the payment for the consultation session scheduled through communication channels 24 (twenty-four) hours before the consultation, if the patient makes the payment in the territory of the European Union, or 72 (seventy-two) hours before the consultation, if the patient makes the payment from a bank located outside the territory of the European Union, by sending a copy of the payment order to the e-mail address dzintari@dzintari.lv. Information about the clinic’s bank account is available on the Clinic’s website: https://dzintari.lv/kontakti/ – the payment explanation must state: type of consultation, specialist, date and time of consultation.3.2. The time when the money has entered the Clinic’s account is considered the time of payment.3.3. If the consultation in the communication channels is interrupted due to technical reasons for which the Clinic is not to blame, the money will not be returned to the patient, which the patient is warned about when applying for the consultation.
4. Application for consultation of communication channels and its progress
4.1. Consultation on communication channels is done individually and is not intended as a couple’s consultation.4.2. To apply for a consultation through communication channels, the patient submits an electronic application in the “Apply for a consultation” section of the Clinic’s website www.dzintari.lv or requests a consultation by phone at +371 67147833. 4.3. In the application, the patient indicates his name, surname, contact phone number and e-mail address. Patient contact information, incl. e-mail, will be used to communicate with the patient for organizing the consultation, coordinating the date and time of the consultation, sending the address of the specialist’s communication channels, as well as sending the invoice for the consultation.4.4. The consultation on the communication channels starts at the previously agreed time, and its duration is 45 (forty-five) minutes (the duration of a repeated consultation with a psychiatrist is up to 30 minutes).4.5. Using a video call, the patient is the first to connect or call the address/number/virtual room of the specialist’s communication channels indicated above.4.6. When starting a consultation with a first-time patient, the patient’s personal data and contact information are specified: first name, last name, personal identification number, current place of residence and phone number.4.7. If the first visit has already taken place in the Clinic, the Patient’s questionnaire is not filled out.4.8. Consultation in communication channels is not offered or is canceled in the following cases:4.8.1. the patient is deaf or hard of hearing;4.8.2. there is inappropriate technical equipment – for example, there is regularly a poor-quality Internet connection, there is no video camera, the patient does not have the opportunity to be alone in the room, etc.;4.8.3. the patient does not comply with the confidentiality rules and/or does not pay for the therapy.4.9. During consultations, after evaluating the patient’s condition, pharmacotherapy is prescribed if necessary.
5. Processing of personal data
5.1. The processing of the patient’s personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and the free movement of such data and which repeals Directive 95/46/EC (General Data Protection Regulation), Patient Rights to the requirements of the Law, the Law on Psychologists, other external and internal regulatory acts of the Clinic.5.2. The processing of personal data is necessary (processing purposes) in order to provide consultations to the patient, to communicate about the time of the consultation in communication channels or to provide other information related to the consultation, to make payments, as well as to fulfill the obligation imposed on the Clinic by regulatory enactments.5.3. The legal basis for personal data processing is Article 6, Clause 1, subparagraphs a) and c, Article 9, Clause 2, subparagraph h) of the General Data Protection Regulation.5.4. The clinic does not disclose patients’ personal data to third parties, neither in the European Union nor outside the EU/EEA member states. The disclosure of patients’ personal data can only take place in the case, to the extent and according to the procedure specified in the regulations, however, when using these communication channels, there is a possibility that the developer of the communication channel and maintainer located outside the borders of the European Union, according to the policies provided by the developers and consents of the patient during the installation of the app. By applying and starting consultations in communication channels, the patient agrees to indicate and receive information containing personal data in communication channels.5.5.
